Property Owners Protest and It Must Angle West Three Blocks on Bennett Lane.

Owing to the protest of Second avenue property owners, it is unlikely that the new line the Phoenix Street Railway company is now construction will extend farther up that thoroughfare than Bennett Lane. At that point the line will switch westward to Fifth avenue and again go north.

“We are not yet certain whether we will go straight out Second avenue or adopt some other route from that point,” said Manager S. H. Mitchell of the railway company last night. “We would rather go out Second avenue, of course, and still hope to be able to do so.”

But owners of property on that avenue, north of Bennett Lane, say that they will not permit this and will apply for injunctions to prevent the company carrying out its original intention.

The company’s franchise gives it the right to lay track on any street in Phoenix. This franchise, however, was granted before Bennett addition was taken into the municipal corporation. When Bennett addition was annexed, one of the conditions was that the owners of property thereis should exercise control over the streets. Therefore they claim that the company’s franchise does not apply to Bennett addition and they will fight any attempt of either the city or the street railway company to put their streets to uses of which they do not approve. And they do not want a street car line up Second avenue, claiming that it will destroy the avenue’s beauty and will be a noisy nuisance during the night.

Bennett addition property owners also exercise control over the north half of Bennett Lane, and if the new line is angled west on that street it will have to be on the south half, which is owned by the city.
